Rental Agreement Terms and Conditions

This agreement (“Agreement”) is made between the below signing individual (“Customer “) and A Blanket & A Basket (“ABAB”).

Now, Therefore, the parties hereby agree to abide and be bound by the following Terms and Conditions with respect to the rented items and equipment (“Supplies”) from ABAB:

ITEMS AND EQUIPMENT
All Supplies are the property of ABAB.

The Customer will use all Supplies only at the location listed on the ABAB Order and Invoice form and only for the purpose for which it was intended and for which equipment was manufactured.

Subleasing or improper use of items and equipment is prohibited.

Customer has read all instruction manuals, operating instructions and warnings related to rented items.

Customers are responsible for the Supplies from the time of possession to the time of collection on location. Customer’s right of possession terminates upon the expiration of the rental period set forth on the contract.


PERMITS: Customer is responsible for giving any local or other authorities any necessary notice of their intention to occupy an area within the authorities’ locality and shall pay all fees and obtain all permits in connection with the planned activity or required by the identified location authority. Customer is solely responsible for knowing and complying with any use restrictions relate to the location, such as but not limited to (balloons, fire sources, hours)

ACCESS: In order to set up and retake possession of the Supplies, ABAB employees, designees or contractors must lawfully enter into or upon any premises where the Supplies will be provided. Customer is responsible for obtaining the contracted location access permits and lawful entry for ABAB.

Failure of Customer to obtain lawful access for ABAB for the contracted location will result in forfeiture of payment, up to the entire amount based on date of notification to ABAB in accordance with the Payment Section of this Agreement.

Access to the picnic location must have designated walkable path and parking within 50 meters.

HIRE PERIOD: The hire period is the total amount of time the Customer will have in their possession the Supplies (“Hire Period”). Picnics are quoted on three (3) hour or more Hire Period. ABAB set up and collection of Supplies are not included in the Hire Time.

Unless otherwise agreed in writing by ABAB and the Customer and consistent with the EXTENDED HIRE requirements below, all hire times are for a three (3) hour period.

Extension to the Hire Period will not occur in the event the Customer does not arrive on time. The commencement and conclusion time of a booking will remain as per the original agreed upon booking.

As ABAB will remain on scene until the Customer arrives on location and signs off on the good condition and delivery of the Supplies, if a customer is greater than 30 minutes late to the booking, forfeiture of the booking will occur and full payment for the rendering of the Supplies will be charged to the Customer.

EXTENDED HIRE PERIOD: The Customer agrees that the booking is for the agreed duration as confirmed at the time a deposit is made for the picnic. A request to extend the booking duration must occur at least three (3) days prior to the booking date and is subject to availability. No refunds will be issued in the event the extended hire is not fully utilized.

Extended hire is charged at a rate of $_30__ per 30 minutes with a maximum extension of one (1) hour.


PAYMENT: A Non-refundable deposit of 50% is required to secure a date.

The final payment is due 3 days (72 hours) prior to the scheduled date.

By making full payment, Customer confirms understanding and agreement of the Terms and Conditions of this Agreement.

Payment details can be found on the invoice sent to the Customer.

Supplies and Equipment will not be released to the Customer until full payment has been received.

Waiver of Defects: Customer agrees to make a complete and thorough inspection at the time of delivery and receipt of Supplies from ABAB. The Customer will notify ABAB prior to taking possession of the Supplies for the Hired Period of any apparent or observable defects, damages, or deficiencies. If no notice of any defect, damages or deficiencies is given to ABAB, then Customer acknowledges ABAB Supplies were received in good, safe, and normal working condition and fit for Customer’s intended use.

Damage Waiver: A Non-refundable damage waiver is added to protect the Customer from charges incurred due to normal wear and tear on rented Supplies. All broken and damaged items, including broken glassware and China must be returned to ABAB for the damage waiver to apply. If collecting the pieces is not possible or safe (i.e., Shattered glass), the Customer is instructed to take a photograph of the item and send it to ABAB for our records. The damage waiver does not preclude the Customer from paying for missing or lost Supplies. It does not protect you from paying for the full replacement fee for damaged items not consistent with normal wear and tear.

IDENTIFICATION REQUIREMENTS: Customer will be required to show proof of identification, such as a state issued license or passport matching the booking information upon picnic set up.

CANCELLATIONS & REFUNDS: As ABAB held a date exclusively for your picnic The 50% deposit is nonrefundable.

Cancellation within 72 hours of the scheduled picnic date will result in forfeit of the full amount of the payment.

ABAB reserves the right to cancel the booking within any period leading up to the date of the event. In the event this occurs, the Customer will be refunded the entire amount paid to ABAB, including the initial 50% deposit, except when Customer has failed to fulfill their obligations under the Terms and Conditions of this Agreement.

INCLEMENT WEATHER: In case of inclement weather and cancellation is required, ABAB will make reasonable efforts to reschedule your picnic as follows:

Reschedule the picnic to an alternate date pending ABAB availability. ABAB will hold the reschedule option open to the Customer for a period of six (6) months. Thereafter, ABAB will return the payment made by the Customer. This is an inclement weather ONLY refund policy.

INSURANCE and HOLD HARMLESS: Customer shall maintain, at Customer’s expense liability, property, and casualty insurance coverage in sufficient amount to fully protect ABAB and its Supplies against any and all claims, loss, or damage. In the event of a loss or damage, Customer shall exercise and empower ABAB to exercise all your rights to obtain recovery under insurance and shall cooperate with ABAB to obtain recovery. Customer agrees to assume all risk and agrees to hold ABAB and any of its staff or contractors harmless from and against any and all claims, losses. Liability and damage and all costs and expenses arising directly or indirectly at, of or related to delivery, set up, loading, unloading, collection and use of Supplies and any injury or damage during use of rented Supplies and Equipment.

LIABILITY: ABAB shall in no way be held legally responsible or accountable for any damage, injury, death, or loss of income caused to the client, any third parties or properties due to hire, rental or operation of Supplies or services provided by ABAB. All Supplies are hired and the responsibility of the Customer until returned to ABAB.

INDEMNITY: Customer hereby indemnifies and agrees to save and hold ABAB harmless from any and all claims, liabilities, loss, expense or damage arising out of the ordering, booking, rental, use, condition or operation of Supplies during the Hire Period, including liability for death, injury to persons, damage to property, and strict or tort liability under the laws of any state or the United States federal laws. Unless the claim, loss, damage, or liability arises out of the sole and exclusive willful or wanton misconduct or gross negligence of ABAB.

WARRANTIES: ABAB makes no warranty of any kind, express or implied, including without limitation, warranty of merchantability and fitness for a particular purpose or use.

FORCE MAJEURE: If ABAB is unable at any time to perform any of its obligations whether wholly or in part by reason of any cause beyond its control (including without limitation acts of God, inclement weather, strikes, lockouts, bush fires, fires, floods, traffic accidents, riots, pandemics, civil commotion or unrest, acts of governments, interference by civil or military authority, terrorist attack or act of war) ABAB may give written notice to that effect to the Customer, giving reason for such force majeure in which case the obligations of ABAB under this Agreement shall to the extent they are affected by the force majeure, be suspended during the term of the force majeure. ABAB shall not be liable for any losses or damage suffered by the Customer as a result of any delays caused but such force majeure events nor will ABAB be liable for loss or damage suffered by the Customer in the event of the Customer cancelling or postponing due to a force majeure event.

ENTIRE AGREEMENT: This Agreement constitutes the entire agreement of the parties and supersedes all prior oral or written agreements and understandings with respect to the subject matter of this Agreement. This Agreement shall not be modified except by a writing executed by Customer and ABAB.
